Michael Abbott: Donald the Torturer Rumsfeld RESPONSE

Timothy Bancroft-Hinchey must be Michael Moore's long lost brother.  They both have a knack for leaving out certain facts when they write or produce.  The problem with the argument of war crimes is that the Geneva Conventions do not apply in this case.  Timothy leaves this out of his rant.  I am going to guess that he thinks that the Iraqi resistance falls under the following portion of Article 4.
 
Members of other militias and members of other volunteer corps, including those of organized resistance movements, belonging to a Party to the conflict and operating in or outside their own territory, even if this territory is occupied, provided that such militias or volunteer corps, including such organized resistance movements, fulfill the following conditions:
     (a)  that of being commanded by a person responsible for his subordinates;
     (b)  that of having a fixed distinctive sign recognizable at a
          distance;
     (c)  that of carrying arms openly;
     (d)  that of conducting their operations in accordance with the laws and customs of war.

I do believe (b) and (d) rule out they would be covered under the Convention, but he could be referring to:
 
Inhabitants of a non-occupied territory, who on the approach of the enemy spontaneously take up arms to resist the invading forces, without having had time to form themselves into regular armed units, provided they carry arms openly and respect the laws and customs of war.

Unfortunately we are constantly reminded that we are an occupying power, so that rules this group out.  What I would like to know is, where is the outrage over the beheading of civilians?  Did you know that all the civilian contractors in Iraq would be subject to the conventions, because they are sanctioned by the US Military (AKA: Occupying Power). 
 
Persons who accompany the armed forces without actually being members thereof, such as civilian members of military aircraft crews, war correspondents, supply contractors, members of labor units or of services responsible for the welfare of the armed forces, provided that they have received authorization, from the armed forces which they accompany, who shall provide them for that purpose with an identity card similar to the annexed model.

Where is the outrage now Mr. Bancroft-Hinchey?  Before you start quoting the Geneva Convention you need to read beyond the first page.  You must not have read beyond Article 3 from which you found "proof" of mistreatment.  I do realize your article falls under the Opinion section, and it is your opinion, but your opinion is worthless without all the facts.
