According to the Detroit Police, Weekley was blinded with the grenade, which his fellow cop had thrown through the window to add more drama for the camera. Weekley claimed, that the girl's grandmother had smacked his gun and caused him to pull the trigger.

Grandmother disposed of the arguments. Her fingerprints were not found on the gun either.

The family of the murdered girl is now suing the Detroit Police Department, as well as the city of Detroit:

"Upon Defendants realizing that they had critically injured the seven-year-old girl, they intentionally conspired to cover-up their unlawful acts by providing false and fictitious information to the authorities and to the media regarding the shooting of Aiyana Stanley-Jones, including falsely claiming that the bullet that killed her was fired from inside the lower unit of the duplex rather than from the outside..."

Two previous lawsuits against the killer were dismissed because of deadlock jury and mistrials.

The judge dropped the charge due to a motion by the defense.
