The court sentenced a woman to five to 10 years in prison for swinging her 4-week-old son by his feet at her boyfriend.

The baby's skull was fractured, but he has recovered.

Chytoria Graham, 28, was sentenced on aggravated assault and other charges Wednesday in Erie County Court.

Prosecutors said Graham and her boyfriend fought early on Oct. 8, 2006, after Graham came home from a night of drinking. Graham grabbed her son, Jarron, by his feet and swung him, hitting the boyfriend.

Graham had pleaded guilty to aggravated assault and endangering the welfare of a child, but later withdrew the plea.

Her attorneys said she entered the plea only because she had been drinking on the night of the fight and, as a caring mother, felt she was responsible for whatever happened to the child.

Graham's attorney, James Pitonyak, said she planned to appeal her conviction.
