Louisville's smoking ban heavily criticized

Churchill Downs racetrack, to be exact its exemption, made the Jefferson County Circuit Court annul Louisville 's smoking ban.

The law was passed in 2006 and bans smoking in all buildings open to the public and other establishments where employees work with the exception of Churchill Downs. The track was excluded because it is "historically and legally in a different class" and has "favored status" because of its "integral part" in the economy.

But last month it turned out that the exemption in the current law violates the Kentucky constitution.

After a series of discussions it’s still unclear, whether the current smoking ban will be reverted or there will be made some amendments to eliminate any exclusive rights.
