American celebrity Lindsay Lohan is suing a Wall Street company, claiming a 'milkaholic' baby used in one of its adverts was modelled on her.
The actress filed a 100-million-dollar lawsuit claiming a television ad for E-Trade - which aired during the Super Bowl and Olympics - was based on her.
Talking babies in the ad engage in chatter that refers to "milkaholic Lindsay". The 23-year-old actress has famously sought substance abuse treatment.
Lindsay's New York lawyer contends that "Lindsay" is an equally recognisable moniker for her client - like that of Oprah or Madonna, The Press Association reports.
According to Wall Street Journal, the lawsuit alleges that the depiction of the second girl "disregarded and violated" Ms. Lohan's right "to the exclusive control of the commercial use of her likeness, name, characterization and personality." It also alleges violations of two sections of New York's civil-rights law.
Ms. Lohan's lawyer, Stephanie Ovadia, said she has heard from many people willing to help her prove her case. "They've said that Lindsay [Lohan] was the first person they thought of when they saw the commercial," Ms. Ovadia said. "People seem very willing to help."
The spokesperson for Grey Group, which produced the "milkaholic" commercial, said that they "just used a popular baby name that happened to be the name of someone on the account team."
In the lawsuit, Lohan is seeking an injunction to force the spot off the air, Us Magazine reports.
