It appears that the major media experts can gripe about Arizona’s law to get rid of criminal illegal aliens, but they can’t seem to be able to post a link so that people can actually read it.
They praise the Feds for their lawsuit, predicting it will win, but also don’t appear able to post a link to the Federal lawsuit against Arizona’s SB1070.
Of course the United States Constitution protects Arizona’s Right to self-preservation.
Our Constitution protects all of the States’ Rights that protect their citizens from harm.
First, common sense should tell us that. Does it make any sense, to anyone, that a group of people in 1776 broke their bonds from a tyrannical ruler, only to give all of their freedoms over to a new bunch of bureaucrats?
For 400 years, immigrants from all parts of Earth came to America for freedom, liberty and justice. They did not come here for free handouts. They did not come here to take whatever they could take.
They came to give. They came to give their talents, their work, their money and their lives in order that common men every where could live in peace, free of oppression and prosper according to their own desires.
They came to build a place on Earth where all people were welcome to create, invent and be able to live in an environment where they did not have to fear speaking their minds.
FREEDOM!! That is why they came. They came to build, not destroy. And because of those brave souls, risking their freedom, their lives and their fortunes in the very act of attempting to reach our shores, America was a single stronghold of Liberty for all. A concept totally unheard of in all of mankind’s history.
As those immigrants prospered or their descendants prospered, they gave back into the system that enabled them to live their lives in freedom. Those immigrants gave back to America and in the process, they gave wonderful gifts to people all over the World.
America helped to give to all inhabitants on Earth, electricity, automobiles, telephones, radio, television, airplanes, computers, medical miracles and the most important gift of all: Oil.
Without oil, civilization would come to a grinding halt. If people want to gripe about oil, tell them to eliminate all oil based products from their lives. They can’t.
Illegal aliens give nothing. They only take. Like a cancer eating living cells, illegal aliens drain the lifeblood from society. They assault and obliterate social welfare systems. They use services they don’t need or ones that they just want for free. Hospitals have closed. Schools produce 50% drop out rates, because kids can’t learn with all the Spanish babble going on.
Mexican illegal aliens are by far the dirtiest, most criminal aliens that we have in America. They are rude and arrogant, believing that they have a Right to free food, free housing, and free medical care.
They cut in lines, use their car horns for doorbells, throw their dirty diapers in the streets, toss trash anywhere with no thought, refuse to obey traffic laws, drive drunk, hit and run, rape and murder children, abandon their own children and wives. They are the most God awful selfish things on two legs. They refuse to learn English, which I think is incredibly ignorant. Even 4 year old children speak English. They put giant speakers outside in their yards, turn them up to rock concert level and go inside to party.
Mexican illegal aliens are revolting. And they know it. It is their purpose to disrupt us, interfere with us and give us diseases that we haven’t had in this country for 100 years.
They trash out a public restroom worse than a group of drunks. They pee all over the toilet and the floor. When they wipe their butts, the dirty toilet paper goes on the floor. When the wind blows, their used toilet paper gets picked up by the neighbors, in the neighbor’s yard.
I asked a Mexican one time, “Why do you pee all over the toilet?”
“Because I want everybody to know a MAN used that bathroom.”
The Tohono O’odham Tribal Lands, a Native America Nation, cleans up 4.3 million pounds of trash a year, from illegal aliens passing through their lands. Every year, illegal aliens dump 12,000,000 pounds of clothes, blankets, bottles, toilet paper and all sorts of traveler’s paraphernalia.
Their crimes are the most brutal and senseless of any we see in America.
Along with Mexican criminal illegal aliens, the law enforcement authorities apprehend people from all over the World coming in from Mexico.
The sovereign State Of Arizona has become the gateway for all manner of human filth.
The Mexican military escorts and provides cover for drug smugglers and human smugglers.
Armed Mexican soldiers have been caught over 200 times in the past 10 years, inside America. We have seen their vehicles and have seen their helicopters far inside of American air space. Mexican troops have held our law enforcement personnel at gunpoint on US soil and have actually fired weapons at our law enforcement on US soil.
Under United States Code, Title 18, Chapter 113B, §2331 an “Act of War” is defined as: any act occurring in the course of—
(B) armed conflict, whether or not war has been declared, between two or more nations; or
(C) armed conflict between military forces of any origin;
Mexico has repeatedly committed Acts of War against America.
Mexico has used it’s armed military forces to escort invaders into our Country.
Arizona has every Right to expel the criminal illegal aliens. Arizona, as a sovereign State, has full Rights under the US Constitution and under International law, has the Right to send crack commandoes into Mexico City and bomb their damn Congress into oblivion and shoot anyone who gets in their way. At the same time evict every single Mexican Consulate employee.
Article 1, Section 8 of The Constitution of The United States of America lists the enumerated powers of the Federal government. Number 15 states: “To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions”
The original creators of the US Constitution specified that ALL States are sovereign, in control of their own destiny. The US Supreme Court, for over 200 years has held that which was expressed in 1990 in Howlett v. Rose, 496 U.S. 356: "Federal law is enforceable in state courts not because Congress has determined that federal courts would otherwise be burdened or that state courts might provide a more convenient forum - although both might well be true - but because the Constitution and laws passed pursuant to it are as much laws in the States as laws passed by the state legislature. The Supremacy Clause makes those laws the supreme Law of the Land, and charges state courts with a coordinate responsibility to enforce that law according to their regular modes of procedure. The laws of the United States are laws in the several States, and just as much binding on the citizens and courts thereof as the State laws are... The two together, form one system of jurisprudence, which constitutes the law of the land for the State; and the courts of the two jurisdictions are not foreign to each other, nor to be treated by each other as such, but as courts of the same country, having jurisdiction partly different and partly concurrent ”
In the case, Claflin v. Houseman, 93 U.S. 130, 136 -137. Such a court may not deny a federal right, when the parties and controversy are properly before it, in the absence of a "valid excuse." Douglas v. New York, N. H. & H. R. Co., 279 U.S. 377, 387 -389. An excuse that is inconsistent with or violates federal law is not a valid excuse: The Supremacy Clause forbids state courts to dissociate themselves from federal law because of disagreement with its content or a refusal to recognize the superior authority of its source.
The requirement that a state court of competent jurisdiction treat federal law as the law of the land does not necessarily include within it a requirement that the State create a court competent to hear the case in which the federal claim is presented. The general rule, "bottomed deeply in belief in the importance of state control of state judicial procedure, is that federal law takes the state courts as it finds them." Hart, 54 Colum. L. Rev., at 508; see also Southland Corp. v. Keating, 465 U.S. 1, 33 (1984
States are REQUIRED to enforce Federal laws. Individual States can make their own laws, unless they conflict with the US Constitution.
And, “Although the state court was not free to dismiss the federal claim” because it is a federal one. 324 U.S., at 123
If the Feds don’t like Arizona enforcing Federal law, too bad.
The US Constitution, Article 4, Section 4 states:
“The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of then against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.”
The US Constitution, Article 6, Section 2 states: This Constitution, and the laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, and nothing in the Constitution or Laws of any State to the Contrary notwithstanding.
The lawsuit filed against Arizona by a President’s Department of Justice is insane and it’s only purpose is to stop Arizona from defending its citizens and to encourage criminal illegal aliens to enter this Country, by prohibiting Arizona from enforcing Federal and State law.
This would only help the administration’s friends in the dope business.
Another reason that a President would do this, would be to cater to 20 million criminal illegal aliens in an attempt to get their vote in future elections.
Even The US government’s General Accounting Office report suggests the US government look to Arizona for inspiration.
The Federal lawsuit is titled: The United States OfAmerica, Plaintiff, vs The State of Arizona; Janice K. Brewer, Governor of the State of Arizona; in her official capacity.
In the introduction, paragraph 2 says, “In our constitutional system, the federal government has preeminent authority to regulate immigration matters,……the Constitution and the federal immigration laws do not permit the development of a patchwork of state and local immigration policies throughout the country.”
This is true, but has no bearing on Arizona’s SB 1070. Arizona is simply giving public notice that they will begin enforcing Federal immigration laws, which as stated above in many US Supreme Court rulings, is not only a Right of the individual States, but a responsibility as well.
Paragraph 3 states: “The mandate to enforce S.B. 1070 to the fullest extent possible is reinforced by a provision allowing for any legal resident of Arizona to collect monetary damages by showing that “any official or agency ….[has] adopt[ed] or implement[ed] a policy” that limits or restricts the enforcement of immigration laws….to less than the extent permitted by federal immigration law.”
A President who has read the Constitution would know: 1. Good to sue lawbreakers. 2. Bad to sue law enforcers.
Citizens are required under penalty of jail, to report crimes.
Paragraphs 4 and 5 move on about how immigration is too complex for anybody but the Feds to understand. Paragraph 5 admits: “The United States government understands the State of Arizona’s legitimate concerns about illegal immigration and has undertaken significant efforts to secure our Nation’s borders. The Federal government moreover welcomes cooperative efforts by States and localities to aid in the enforcement of the nation’s immigration laws”
“Welcomes cooperative efforts”? That’s just plain silly. It is required for the States to assist.
Paragraph 5 finishes with; “But the United States Constitution forbids Arizona from supplanting the federal government’s immigration regime with its own State specific immigration policy.”
Arizona is not ‘supplanting” the federal laws. It is enforcing existing US Immigration policy through enforcement of Federal laws that the Feds won’t enforce. US attorneys should not use big words they don’t understand in a court filing.
Supplant means:
1. Oust somebody: to take somebody’s place or position by force or intrigue
2. replace: to take the place of something, especially something much used, inferior, outmoded, or
The Feds know nothing is being replaced or changed.
In paragraph 18, the lawsuits admits that the Federal government does not enforce laws against illegal aliens generally as a policy, but only for, “those aliens who pose a danger to National Security or a risk to public safety.”
The vast majority of the America public thinks that ALL illegal aliens pose a risk to public safety. The Feds refuse to enforce the law, so Arizona has elected to do so.
Referring the Arizona Suns baseball team owner criticizing SB 1070, Arizona Governor Jan Brewer on FaceBook wrote: "What if the owners of the Suns discovered that hordes of people were sneaking into games without paying?
What if they had a good idea who the gate crashers are, but the ushers and security personnel were not allowed to ask these folks to produce their ticket stubs, thus non-paying attendees couldn't be ejected.
Furthermore, what if Suns' ownership was expected to provide those who sneaked in with complimentary eats and drink?
And what if, on those days when a gate-crasher became ill or injured, the Suns had to provide free medical care and shelter?"
She is putting it lightly. I will take it a step further with more reasons why we can not afford illegal aliens. What if these gate crashers raped your 4 year old daughter and murdered your mother?
Arizona ’s law is designed to stop their crime wave. Phoenix, Arizona has the World’s second highest kidnapping rate, after Mexico City. About 5,000 people per year are murdered in Mexico by the so-called drug cartels. Mexican illegal aliens in America murder 2,500 of us each year and kill another 2,500 in car wrecks.
We have a Right to defend ourselves.
Governor Brewer met with Barack Hussein Obama, the person who occupies the office of President of the United States in Washington, D.C., to address the problem in Arizona. Obama told her he would give her word on what he was going to do in 2 weeks.
Two weeks later, Obama had not called Governor Brewer, but did have the Federal government post signs on Public lands in Arizona near the Mexican border and 80 miles north of the border, saying in effect, “Boogey men are around here. Don’t go in.”
An area of public land, about 2,000 square miles, inside America………and we shouldn’t go there because of drug smugglers that the Feds know about?
The people in America are sick of Obama and his anti-American policies. If Obama doesn’t want to enforce the laws, the States have a Right and a duty to do so. If Arizona doesn’t want to enforce the law, We The People will do it. There are armed groups of Americans in the border area now, patrolling for illegal aliens. And it is well within their Rights to do so.
Some news sources have referred to these armed patrols as neo-Nazis. So what? Whatever it takes.
We, the American citizens, don’t care if Attila the Hun, Genghis Khan, Joseph Stalin, Adolph Hitler and Lady Gaga run these illegal aliens out of the country. We want them gone. Fast. Now. No more Mr. Nice guy. The government should offer a $50 bounty for every one we turn over to Immigration and Customs Enforcement.
“If Obama doesn’t like that, too bad.” If he wants to force the issue, he can further violate our Constitution and send armed troops to the border to engage in battle with law-abiding American citizens. If those troops want to fire on law-abiding American citizens, they should be prepared to be fired back on.
The Federal lawsuit brought against a sovereign State in these United States of America is Treason. Obama is giving aid and comfort to foreign invaders, supported by a proven, hostile foreign military force.
The Constitution defines Treason as: “ Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort.
Oran 's Dictionary of the Law (1983) defines treason as "...[a]... citizen 's actions to help a foreign government overthrow, make war against, or seriously injure the [parent nation”.
There are 7 lawsuits against Arizona’s SB 1070. Normally, cases in Federal court are assigned to judges on a random selection. But in these cases, all but one have been assigned to US District Federal Court Judge Susan Bolton. She appears to be fairly considering each party’s claims. That’s the problem.
The Federal lawsuit should have been dismissed in 60 seconds and the Federal attorneys personally penalized for bringing a frivolous, unconstitutional lawsuit to court. I would recommend a punishment of monetary damages to pay for court costs and related expenses as well as 30 days in jail, with 8 hours of classes every day on the US Constitution.
The decision is one of the most simple decisions in lawyerly circles: Enforce a law or not?
If Judge Bolton does issue a ruling for Arizona not to implemant SB 1070, and Arizona obeys that ruling, the American people have a Constitutional Right and a Constitutional Duty, to expell all resident illegal aliens and repell all attempts to enter Arizona illegally, with deadly force. Anyone who attempts to interfere with that action, will do so at their own risk.
Americans have a Right to make Citizens’ Arrests.
None dare call it Treason? Well I do. I scream it out and so should every American.
