Guantanamo prisoners' goes to Supreme Court of the US

Supreme Court of the US will hear appeals of the detainees from the Afghan war held in Guantanamo Bay, Cuba. However, firstly the court shall decide on jurisdiction of American courts to hear appeals of the detainees in general.

Bush administration claims that because the detainees are not US citizens and are being held outside of the country, normal POW laws are not applicable in their case. A court of appeal of Columbia DC declined the claim that the prisoners are in fact under US control, as the territory they are being held on is rented by the States from Cuba. If Supreme court satisfies the present appeal, the case will return to the court of Columbia, which shall continue the hearings on legality of the imprisonment of the detainees. "The USA created a prison in Guantanamo Bay, which works above the law", claims the petition to the court by the lawyers of 12 Kuwait citizens, 2 Australians and 2 Britons.

In October, Christof Zirod the head of the International Red Cross Committee department in Washington, criticized the conditions in Guantanamo prisons, in which the detainees have being held for an unknown period without official charges.
